An extraordinary week. This blog post by Kevin Smith, J.D from Scholarly communications @ Duke is another nice summary of Elsevier and public access legislation stories. See also my post.

The Elsevier Boycott and its relationship to WUSM Although written from WU School of Medicine perspective, the "Facts and Figures about Elsevier's Impact at Becker Library" is useful in describing pros and cons of the current WU no-cancellations contract with Elsevier. Even given the "pros" I can't imagine that the Danforth campus will continue this contract much longer. We'll see.

Is the pot calling the kettle black? This blog post, by Stuart Shieber in The Occasional Pamphlet on scholarly communication, compares rising tuition/cost of attendance prices with rising journals prices (he calls this hyperinflation of journal prices). His price information is from what Harvard University pays. I think he makes a good case that what has been going on with institutional subscription prices in recent years is really something extraordinary.

Scholarly publishing in the news; public access legislation and the Elsevier boycott

Elsevier Boycott:
The Cost of Knowledge, boycott Elsevier, petition has more than 7,000 signatures so far, including our own Professor John E. McCarthy. This site was started by the math community in response to Tim Gowers's blog post Elsevier — my part in its downfall, Jan. 21, 2012. Response has been widespread and thoughtful regarding the role of publishers and how scholarly publishing might develop in the future. Undoubtedly this response to the boycott is the direct cause of Elsevier's response today:
A letter to the mathematics community Feb. 27, 2012 including Elsevier Withdraws Support for the RWA. [Also I started seeing stories on Feb. 27th that RWA legislation is dead.]
I can't begin to list all the discussions generated by this movement. I'm sure you have seen a lot of it. The Journal Publishing Reform site on the PolyMath wiki brings together a lot of it.

Public access legislation and anti-public access legislation:
I find myself a bit skeptical about all this proposed legislation, such as Research Works Act RWA and Federal Research Public Access Act FRPAA. I doubt that either RWA or FRPAA will pass this year, but I do find all the discussion interesting. Heather Joseph from SPARC wrote a nice summary of a lot of these goings-on: Prime Time for Public Access. The Alliance for Taxpayer Access is currently maintaining a Comprehensive list of FRPAA & RWA in the news.

This open letter from 11 Research University Provosts from Inside Higher Education, Values and Scholarship, is an example of what I am talking about when I mention the discussion about the future of publishing. It is clear in this letter than commercial publishing is not the only sphere that will see change. Campus and administrator behaviors will expect change too, e.g., "ensuring that promotion and tenure review are flexible enough to recognize and reward new modes of communicating research outcomes" and so forth.

Do Mathematicians Get the Author Rights They Want?

There is a nice article in the Scripta Manent series of Notices of the AMS 59(3) March 2012: Do Mathematicians Get the Author Rights They Want?, by Kristine K. Fowler. Since math folks read this journal, it will reach a good audience and I assume most of you have already seen this article. I only have a couple of quibbles.

1. I wish a paragraph had been added urging authors to keep records about their copyright transfer agreements and negotiations. It is surprising to me how often authors do not know or remember what agreements they have and have not signed.
2. Table 1: "Rights Explicitly Retained by Authors in Standard Journal Publishing Agreements from Selected Mathematics Publishers" looks quite useful but ignores the Elsevier exception about posting author-created versions, which Elsevier calls "Accepted Author Manuscripts" in online repositories when mandatory. Since WUSTL's open access resolution is voluntary, not mandatory, this does not prevent WUSTL authors from posting their articles in our repository, openscholarship.wustl.edu/, when it is ready for such submissions [coming soon]. But there is some concern about this "systematic distribution" exception among universities with deposit requirements. The Confederation of Open Access Repositories (COAR) has posted an Open Letter to Elsevier about this issue.

While we do not give legal advice here in the libraries, we are happy to help with questions concerning your rights and how to retain the rights you want when you publish.
